By applying to participate in the Beaut.ie and Vichy Aqualia Thermal Sample Kit Trial (the “Trial”) and the Vichy prize draw (the “Prize Draw”) (together, the “Campaign”) you are agreeing to these terms and conditions between you, Beaut.ie and Vichy (trading division of L’Oréal (UK) Limited (“Vichy”). Beaut.ie and Vichy are referred to together in these terms and conditions as “the Promoters”.
Applying to participate in the Trial and Prize Draw
1. Application to participate in the Campaign is open to Republic of Ireland and Northern Ireland residents, aged 18 years old or over. The Campaign is not open to any Vichy or beaut.ie employees, their immediate families or anyone professionally connected with the Campaign. No purchase necessary. Entry to the Campaign is free.
2. If you would like to apply to participate in the Campaign, you should follow the entry instructions as set out in point 3 and 4. Entrants must have internet access to be eligible.
3. You will be required to provide contact information to beaut.ie including your full name, your email address and a daytime contact number, as well as the information and material required by the Promoters as detailed in Point 4. You must provide complete, accurate and up-to-date information.
4. In order to be eligible to apply to participate in the Campaign, you must 1) read and accept these terms & conditions and 2) complete the entry questions.
5. Sixty-five (65) participants will be selected to participate in the Trial, and one (1) person from all entrants for the Campaign (whether chosen for the Trial or not) will be chosen as the winner of the Prize Draw. Both the Trial participants and the Prize Draw winner are drawn at random and such decisions shall be final and that there will be no right of appeal against any decisions taken by the Promoters on this matter. Due to the large number of applications which the Promoters may receive, unsuccessful applications will not be notified.
6. One entry per person. Applications on behalf of another person will not be accepted. Bulk entries from trade, consumer groups or third parties will not be accepted. Multiple entries made by the same person from various email or other accounts or from the same IP address will not be accepted. Incomplete, illegal, misdirected or late entries will not be accepted. Proof of sending will not be accepted as proof of receipt. Responsibility cannot be accepted for lost, damaged or delayed entries, whether due to technical or connectivity problems or otherwise.
7. Applications to participate in the Campaign will be open from 23:59pm (GMT) 29.06.2016 to 23:59 (GMT) on 06.07.2016. The draw of winning participants for the Trial will take place on 07.07.2016. The draw of the hamper prize winner will take place on 08.08.2016. The Promoters may change or waive these terms and conditions or cancel the Campaign at any time for reasons beyond their reasonable control.
Privacy
8. You acknowledge and consent that certain data relating to your skin type either provided by you or collected from you during the application process and/or as part of the Campaign may constitute “Sensitive Personal Data” which relates to you.
9. If you are selected as a participant for the Trial, your information may be used in connection with the development, production and exploitation of the Trial.
10. 11. By submitting your application and agreeing to these terms and conditions, you are indicating your consent to your personal information being used as described above.
Participating in the Trial
12. If you are selected to participate in the Trial, you will be notified by email by 07.07.2016. Beaut.ie will send you one Aqualia Thermal sample kit (containing 1 x Aqualia Thermal Light Cream 15ml, 1 x Aqualia Thermal Power Serum 7ml) (the “Product(s)”) to the address you provided in your application email within five working days of you being notified. Please allow 14 days after that date for delivery.
13. If you are selected by the Promoters to participate in the Trial, you agree to use each of the products included in the Aqualia Thermal sample kit twice daily, morning and evening, for 2 weeks starting the day after you receive the Products.
14. If selected, you agree to attend and take part in publicity accompanying or resulting from the Trial if reasonably required by the Promoters. No additional compensation will be awarded for such promotional activities. No compensation for loss of earnings will be paid by the Promoters for participation in any aspect of this Trial.
15. You agree to notify the Promoters as soon as you are aware you are unable to participate in the Trial.
16. You will receive an email reminder by 01.08.2016 to leave your feedback on a self-completion questionnaire at beaut.ie/vichy-trial by 08.08.2016.
17. All feedback must be honest and we welcome all comments on the Products, both positive and negative.
18. You are solely responsible for any and all other costs or expenses incurred by you in applying to participate in and your participation in the Trial. Under no circumstances will these or any additional costs be covered by the Promoters unless otherwise expressly stated.
19. You acknowledge and agree that, if you are selected to participate in the Trial and you have given false information as part of your application or fail to comply with these terms and conditions or any of the Promoters’ reasonable instructions, the Promoters may terminate your participation in the Trial. Any entries which do not comply with these terms will be disqualified. If a prize is declined or if a winner forfeits the prize under these terms and conditions, then the Promoters may at their absolute discretion select an alternative winner at random.
20. If you are selected to participate in the Trial, you will be required to agree to these terms and conditions, including granting the rights set out in the ‘Intellectual Property’ section below.
Hamper Prize Draw
21. If you are the winner of the prize draw hamper, you will be notified by email by 23.59pm (GMT) 08.08.2016. Beaut.ie will send you one Vichy hamper containing ten (10) full size products, being:
• 1 x Vichy Mineralizing Water 150ml;
• 1 x Aqualia Thermal Serum 30ml
• 1 x Aqualia Thermal Light Pot 50ml
• 1 x Aqualia Thermal Night Spa 75ml
• 1 x Aqualia Thermal Eye Awakening Balm 15ml
• 1 x Aqualia Thermal Lips 4.7ml
• 1 x Purete Thermale Pore Purifying Clay Mask 75ml;
• 1 x Purete Thermale Quenching Mineral Mask 75ml;
• 1 x Purete Thermale Double Glow Peel Mask 75ml; and
• 1 x Purete Thermale 3in1 One Step Cleanser 200ml.

22. You agree to take part in publicity accompanying or resulting from the Prize Draw if reasonably required by the Promoters. 23. You acknowledge and agree that, if you are selected as the prize winner and you have given false information as part of your application or fail to comply with these terms and conditions or any of the Promoters’ reasonable instructions, the Promoters may refuse to provide you with the prize. If a prize is declined or if a winner forfeits the prize under these terms and conditions, then the Promoters may at their absolute discretion select an alternative winner at random.

Intellectual Property Rights
24. In the event that you are selected to participate in the Trial, you agree and consent to (a) providing information, text and feedback in connection with your application and participation in the Trial (your “Contribution”); and (b) the use of your Contribution (in whole or in part) in connection with the Trial or in promoting the Product(s).
25. You irrevocably grant and assign to the Promoters by way of present assignment of present and future copyright, all rights of any nature in and to the rights, title and interest in your Contribution so as to permit the fullest use throughout the world of the Contribution or any part(s) thereof by all means and in all media (including online, digital and print) in connection with the Trial or otherwise in perpetuity. For the avoidance of doubt, you agree that the Promoters have the right to edit, copy, adapt or translate the Contribution as they see fit.
26. You further agree that any photographic material(s), video material(s) and/or any other materials (including your name and city, material provided in your application email, quotes and reviews/testimonials) you have submitted as part of your application to participate in the Campaign (collectively referred to as your “Submission”) may be used by Vichy to promote the Campaign and/or the Product(s) and you promise that you have the necessary licences, rights, consents and permissions to authorise the Promoters to use your Submission in full or in part
27. You grant the Promoters a worldwide, perpetual, royalty free and transferable licence (with the right to sub-licence) to use, edit, record, modify, translate, distribute, make available to others, prepare derivative works of and exploit your Submission by any medium or method whether now known or later developed throughout the world for the full term of copyright and other rights and all renewable and extension thereof.
28. You agree that your Contribution and/or Submission may be edited, adapted, displayed, or published in all media (print and internet) for the purposes of PR, advertising, marketing or promotion by Vichy or beaut.ie on “Materials”, including but not limited to the beaut.ie site, Vichy website and other third party websites, social media (including facebook, Youtube, Twitter, Instagram, blogs, vlogs, e-newsletters, press releases, editorial, point of sale material, newsletters, advertorials and trade press etc. and/or otherwise made publicly available at the discretion of the Promoters.
29. You grant the Promoters the right to use your name, likeness, photographs, any videos provided by you and age in connection with the administration, promotion and exploitation of the Campaign and/or promoting the Product(s) and/or ancillary products/services of either of the Promoters, throughout the world in all media in perpetuity.
30. You irrevocably waive the benefits of and agree not to assert any provision of law known as "moral rights" or any similar laws of any jurisdiction in respect of your Contribution and/or Submission. You will, if requested by the Promoters, do all such things and execute all such documents as may be necessary to vest (and perfect the vesting of) such rights in the Promoters.
31. You acknowledge that you give the above consents and grant the above rights relating to your Contribution and Submission in consideration for the benefits, experience and expose you will obtain as a result of being involved in the advertising and/or promotion of Beaut.ie and Vichy. You understand the Promoters will incur substantial expense in creating the Contribution for the Campaign in reliance of the consents and undertakings you have given.
Confidentiality and publicity
32. You must keep confidential and not disclose to any third party any confidential information, photographs or other material relating to the Promoters or the Campaign or anyone taking part in it, which comes to your knowledge as result of your participation in the Campaign.
33. You agree that you will not prior to first public transmission of the Campaign give to any person for publication in any media any interview or make or release any statement, photographs or other material relating to your participation in the Campaign without the Promoters’ prior written approval.
34. A list of the winning participants in the Trial and/or the winner of the Prize Draw can be obtained by sending a stamped, self-addressed envelope to Beaut with a request for the Vichy Aqualia Thermal Trial participant names and/or prize winner name within 30 days of the closing date.
Limitation of Liability
35. Subject to paragraph below of these terms and conditions, you acknowledge that the Promoters shall not be liable for any loss, damage or injury suffered by you in connection with your application and/or participation in the Campaign other than death or personal injury caused by negligence.
General
36. Nothing in these terms and conditions restricts your legal rights as a consumer. For more details on your legal rights you should contact your local Trading Standards Office or Citizen's Advice Bureau in Northern Ireland or Citizens Information (Republic of Ireland).
37. The prize(s) are as stated, they are not transferable and there are no alternative prizes or cash substitutes. The Promoters reserve the right to substitute the prize with one of like value in the event that the selected prize is unavailable for any reason whatsoever.
38. No waiver of any rights by either of the Promoters will be taken as a waiver of any other rights either of them may have.
39. These terms and conditions and any non-contractual obligations arising out of or in connection with them, shall be governed by, and construed in accordance with English law and shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
